Rule 33
Settlement of pending cases

(1) According to sub-section (2) of section 117 of the Civil Criminal Procedure Code, 2074, if the defendant and the victim agree to settle the case in which the Government of Nepal is the plaintiff, both parties can file an application before the relevant public prosecutor's office.
(2) If an application is received according to sub-rule (1), the relevant public prosecutor shall identify the defendant and the victim and if it is deemed necessary to reach a settlement, both parties shall sign the application and send it to the office of the relevant Missile Attorney General along with their opinion.
(3) According to sub-rule (2), the information sent by the District Public Prosecutor's Office for settlement should also be given to the concerned High Public Prosecutor's Office.
(4) Sub-rule: When studying the missal with the petition received as per (2), if it is deemed suitable to do the petition as requested, the Attorney General or the Deputy Attorney General who has delegated the authority shall order the reconciliation and send the order to the relevant 8 Public Prosecutors Office along with the missal for the implementation of that order.
(5) After receiving the order according to sub-rule (4), the concerned public prosecutor's office shall submit an application along with all the documents to the officer looking into the case.
(6) If the petition as per sub-rule (1) comes to the Attorney General's Office or the High Public Prosecutor's Office, such petition shall be sent to the concerned Public Prosecutor's Office for necessary action.
(7) On the application received according to sub-rule (6), the concerned public prosecutor's office shall proceed with the action according to the procedure mentioned in this rule.
(8) Notwithstanding anything written elsewhere in this rule, if a settlement is to be reached in a case of a nature in which the custodian is required to be kept in Rohwar according to the prevailing law, the custodian shall be kept in Rohwar.
